Plenary Session # 3: Regulatory Compliance/Recall Effectiveness - Product Safety Data Collection and Analysis: A Shared Quest For Early Hazard Identification

CPSC has long prided itself on being  a data-driven agency.  Its 2019 budget priorities include augmenting analytical and trend-assessment protocols, thereby expanding CPSC’s ability to analyze and identify emerging hazards.  Similarly, CPSC-regulated companies regularly grapple with how to evaluate data from various inputs (e.g., consumer complaints, claims, commercial customers, traditional and social media, CPSC, etc.) to identify potential safety hazards. 
This panel will discuss information sources available to CPSC and companies, data analysis tools, as well as challenges and successes in the shared goal of identifying potential safety hazards at an early opportunity.  The panel will also explore opportunities to foster a more open sharing of incident data with CPSC, either through an enhanced version of the Retailer Reporting Program or other means.  By working together and discussing these issues, CPSC and industry stakeholders can advance their shared product safety objectives based on objective data collection, analysis, and review.

Eric Rubel focuses on product safety matters and related litigation. Eric was General Counsel to the US Consumer Product Safety Commission (CPSC) from 1994 to 1997. He has extensive experience in representing companies at all stages of a product's lifecycle, including to: ·    address potential safety issues before a product is launched, ·    assess compliance with CPSC regulations, ·    develop effective recalls in the US and as part of coordinated global corrective action plans, ·    avoid unnecessary recalls, and ·    defend CPSC late reporting and post-recall sale investigations and other enforcement actions. Eric and his product safety team represent companies of all sizes ─ from start-ups on up ─ and at all parts of the distribution chain.  They are able to do so effectively and efficiently based upon their decades of experience in CPSC matters.  He also helps clients manage and coordinate the various litigation and regulatory matters that may arise out of product safety issues.
